The compliance deadline is closer than the pitch says

Under the EU AI Act, AI systems used in recruitment — CV screening, candidate ranking, interview scoring, performance analytics — are high-risk by classification. Full enforcement applies from August 2026: mandatory human oversight mechanisms, bias testing, technical documentation, audit trails, and worker notification obligations. Penalties reach €35 million or 7% of global annual turnover. A company selling AI-powered hiring features into EU enterprises without a credible compliance plan is either facing a significant re-engineering sprint, or selling to customers accruing regulatory liability.

Workflow data is the moat — but only if you legally own it

The most defensible HR tech businesses are built on proprietary workforce data: verified hiring outcomes by role and industry, 12-month and 24-month retention data, performance trajectories, churn predictors, compensation benchmarks. That signal depth takes years to accumulate. But owning that data legally — having the right data processing agreements, employer consent structures, and GDPR-compliant retention policies — is a prerequisite for using it in model training. We regularly find platforms where the data exists and is genuinely valuable, but the legal basis for processing it is thin or missing entirely.

Enterprise HR sales cycles require an integration architecture that most early-stage products don't have

HR platform deals in mid-market and enterprise accounts take 6–18 months to close and typically require HRIS integration, SSO configuration, payroll system connection, and sometimes works council approval in Germany, the Netherlands, or France. A platform whose integration architecture requires custom engineering for each customer cannot scale through enterprise channels without proportionally scaling the implementation team. The pitch promises enterprise-ready. The codebase often delivers professional services revenue instead.

AI co-pilots that augment rather than replace HR teams. Tools that help HR professionals make better decisions — rather than making decisions autonomously — sit in a structurally safer regulatory position under the EU AI Act's human oversight requirements, and are often easier to sell to HR buyers with concerns about job displacement.

Risks we surface

High-risk classification that founders haven't factored into their roadmap. Retrofitting bias testing, audit trails, human oversight mechanisms, and technical documentation into a product not built for it is a 12–18 month engineering effort.

Training data that encodes historical bias. A model trained on historical hiring decisions will encode historical biases — gender, name origin, educational institution, career gap patterns. Without structured bias testing across demographic groups, the company is building a product that creates legal and reputational liability for its enterprise customers.

Works council and co-determination blockers in key markets. In Germany, the Netherlands, Austria, and Scandinavia, deploying HR technology that monitors performance, analyses productivity, or automates HR decisions may require formal works council or employee representative approval. This is a genuine enterprise sales obstacle that can stall or block deployments entirely.
